On July 11, 2017, plaintiff Anthony Economus, 19, participated in a downhill skateboarding event on Dolores Street, alongside Dolores Park, in San Francisco. San Francisco police officers were present at the event. Sergeant Flint Paul ordered an officer to park his vehicle across Dolores Street, to prevent skateboarders from traveling down the hill, but the officer only blocked a portion of the street, leaving a gap that still allowed skateboarders to pass. Paul resultantly ordered a park ranger to back up his truck so that skateboarders would run into the cars if they went down the hill. Despite Paul’s order to move the vehicles, skateboarders continued to skate down the hill using a gap between the vehicles. As Economus attempted to head down the hill and proceed through the gap, Paul leaned over and struck him on the back with his shoulder. Economus collided into the hood of police vehicle and then went over the hood, landing yards away. The incident was captured on videotape. Economus sustained to an ankle, a knee and a wrist. Economus sued Paul, alleging that Paul violated Economus’ civil and constitutional rights to be free from excessive force. Plaintiff’s counsel contended that Paul, unlike other officers at the event, attempted to shut down the event, instead of monitor it, and that Paul escalated the situation., Economus sustained a posterior malleolus fracture and small chip fractures to his right ankle. He also sustained a laceration to his right knee and a sprained wrist. Economus was taken by friends to a hospital, where he received sutures to his right knee to close the laceration. Economus had to use a wheelchair, then a boot and then crutches for four to six months. However, he does not require any future treatment or surgery. Economus sought recovery of past medical costs, and damages for his past and future pain and suffering.
