FACTS
On Feb. 2, 2012, plaintiff Sami Saleh, 26, a janitor at a high-rise building, was driving his vehicle on 19th Avenue in San Francisco when it was rear-ended by a vehicle operated by Spencer Lyon. Saleh sustained back . Saleh sued Lyon, alleging the defendant was negligent in the operation of his vehicle. Lyon admitted liability for the accident., The day following the accident, Saleh presented for medical care. He was initially misdiagnosed with a compression fracture of the spine, but was later diagnosed with a bulging disc of his lumbar spine. He subsequently treated with six months of physical therapy. Saleh did not claim any limitations as a result of his injury, but did claim lingering back pain when lifting heavy objects, or sitting or standing for excessive amounts of time. Both the plaintiff’s and the defense’s orthopedic surgery experts agreed that Saleh was misdiagnosed with a compression fracture and agreed that Saleh had intermittent pain in his lower back.
