FACTS
On Oct. 24, 2012, plaintiff Yuliya Levites, 35, was driving on Central Expressway, near Sunnyvale, when he came to a stop due to heavy traffic. While stopped for less than a minute, Levites was rear-ended by a vehicle operated by Jason Nielsen. Levites claimed he injured his neck in the accident. Levites sued Nielsen, alleging that Nielsen was negligent in the operation of his vehicle. Levites also sought further recovery via the supplementary-underinsured-motorist provision of his own insurance policy, which was administered by Farmers Insurance Group of Cos. Nielsen ultimately conceded liability., Levites was ultimately diagnosed with cervical disc bulges at the C3-4 and C5-6 levels, as well as a whiplash injury. He subsequently underwent physical therapy and chiropractic treatment. However, Levites claimed that despite treatment, he continues to suffer from chronic neck pain. Levites’ alleged and damages were not disputed.
