In May 2009, plaintiff Salvador Orozco, an ambulance driver in his 60s, was terminated from his job at Enova Medical Response Inc. He claimed he worked for the company for about 18 months, before he was fired in retaliation for complaining about his paycheck. Orozco sued Enova Medical Response, alleging retaliation and wrongful termination. He claimed that he was fired in retaliation for his complaints about missing paychecks and improper social security withholdings. Enova Medical Response’s counsel withdrew during the proceedings, causing the defendant to proceed pro per. It denied terminating Orozco in retaliation for his complaints and claimed that the plaintiff was actually fired for performance reasons., Orozco claimed that he was unemployed for over one year after his termination. He alleged that his job search was further complicated by his resume gap and inability to procure a reference from the defendants. As a result, Orozco is now employed intermittently.
