FACTS
On Jan. 15, 2016, plaintiff Cheyenne Bryant, 33, an educational specialist, was driving on Interstate 405, near Inglewood. Her car’s rear end was struck by a trailing car that was being driven by Hester Lueb. Bryant claimed that she suffered of her back and neck. Bryant sued Lueb. Bryant alleged that Lueb was negligent in the operation of her vehicle. Defense counsel conceded liability. The trial addressed damages., Bryant claimed that she suffered of soft tissue of her back and neck. She presented to a chiropractor more than 10 days after the accident and underwent approximately 15 sessions of chiropractic care. Bryant’s treating chiropractor was not available to testify, so plaintiff’s counsel called an internal medicine expert who saw Bryant more than three years after the collision. Bryant sought recovery of past and future medical costs, and damages for her past and future pain and suffering. Defense counsel contended that the collision occurred in traffic, at a low speed, and that there was no visible property damage to the vehicles. Counsel argued that such an accident could not have caused the that Bryant claimed to have suffered.
