FACTS
On May 24, 2017, plaintiff Jesus Vargas Reyes, 35, a baker, part-time restaurant worker and student, was driving on Camino Del Norte, in San Diego. While he was stopped at a red traffic signal, his vehicle’s rear end was struck by a trailing vehicle that was being driven by Hongwei Xu. Reyes’ vehicle was propelled forward, and it struck the rear end of a preceding vehicle. Reyes claimed that he suffered of his back and neck. Reyes sued Xu. Reyes alleged that Xu was negligent in the operation of her vehicle. Defense counsel did not dispute liability., Reyes claimed that he sustained soft tissue of his neck and back. He was taken by ambulance to the emergency room at Palomar Medical Center, in Escondido, where he was treated and released. He then presented to a chiropractor and was treated with four months of chiropractic care. Reyes claimed he continues to have pain, mainly in his lower back, and that he will require further chiropractic care. Reyes claimed that he was not able to do his previous jobs at full capacity, but that he was eventually able to obtain other employment doing the same type of work. Reyes’ treating chiropractor opined that Reyes needed the treatment he underwent and opined that Reyes’ treatment was reasonable and necessary. Reyes sought recovery of past and future medical costs, lost earnings, and damages for past and future pain and suffering. The defense’s expert orthopedic surgeon agreed that some of Reyes’ treatment was reasonable and that $2,000 in chiropractic bills was reasonable but opined that anything more than that in duration and expense would be unreasonable.
