FACTS
On March 14, 2012, applicant Michael Noxon, 34, a motorcycle salesman and repairman for Larry Lilley Motorcycles, was involved in an accident while test driving a newly assembled motorcycle. He claimed he subsequently sustained to his head. Noxon sued his employer, Larry Lilley Motorcycles, and the workers’ compensation insurance carrier, State Compensation Insurance Fund. Noxon brought a claim against the defendants to collect workers’ compensation benefits., Noxon allegedly suffered blunt-force trauma to his head, resulting in a traumatic brain injury. After the accident, Noxon was taken to Antelope Valley Hospital, in Lancaster, where he was admitted to the Intensive Care Unit. A CT scan showed a subarachnoid hemorrhage on the left side and a cortical contusion on the right parietal lobe. Noxon was discharged home the following day with further rehabilitative care ordered through Kaiser Occupational Health Services. In April 2012, Noxon was transferred to Centre for Neuro Skills, in Los Angeles, where he underwent extensive neuro-rehabilitation. Noxon’s counsel, with the help of medical experts in neuropsychology and physical medicine, was able to get Noxon admitted into a modified inpatient program at Centre for Neuro Skills, which allowed Noxon to continue with neuro-rehabilitation off-site. Noxon’s counsel contended that as a result of the mild traumatic brain injury, Noxon suffers cognitive deficits, depression, anxiety, and other behavioral issues, as well as vestibular dysfunction.
