On Nov. 6, 2017, plaintiff Thais Yafet, 40, a bartender, fell while she was walking near the entrance to the Bay Area Rapid Transit station located near 815 Market St., in San Francisco. She sustained of her face, mouth, ankles, knees and an elbow. Yafet sued the station’s owner, the city and county of San Francisco. Yafet alleged that the subject area constituted a dangerous condition of public property and that the city and county of San Francisco failed to repair and/or warn of the hazardous condition. Yafet claimed that her fall was a result of her having tripped on an uncovered tree basin that was uneven with the sidewalk. Her counsel contended that the city and county of San Francisco should have known about the dangerous condition, but that its workers failed to repair and/or warn about the condition., Yafet fractured her two front teeth (the central incisors). She also claimed that she experienced pain in her ankles, mouth, knees and an elbow and that began to suffer from right-sided sciatica. An MRI of her right knee revealed scarring of the knee’s ligaments, and an MRI of an ankle revealed edema and thickened ligaments. Yafet claimed that future debridement surgery was recommended to treat one of her injured ankles. Yafet sought recovery of $50,000 in past medical costs (post-Howell) and an unspecified amount in future medical costs. She also sought recovery of damages for her past and future pain and suffering.
