FACTS
On Nov. 16, 2010, at 11:27 a.m., plaintiff Danny Callahan, 57, a taxicab driver, was in a right turn lane in Ventura when a vehicle operated by Evaristo Jimenez moved from the lane to his left and sideswiped him. Callahan claimed a lower back injury from the accident. Callahan brought a claim against Jimenez. He alleged that Jimenez was negligent in the operation of his vehicle. Specifically, Callahan contended that Jimenez’s attempt to change lanes was unsafe., Callahan sustained a lumbar disc herniation at L4-5. He subsequently treated his injury with epidural injections and has not undergone surgery at this time. Callahan did not make a loss of earnings claim. However, he claimed his past medical costs amount to $120,000. Thus, he sought recovery of damages for his past medical costs, as well as for his pain and suffering.
