FACTS
On Oct. 14, 2011, plaintiff Gregg Guenthard, 53, a museum manager, was driving on 8th Street in Los Angeles. At approximately 10:25 a.m., while crossing the intersection at Ridgeley Drive, he was broadsided by a rental vehicle operated by Emily Schwartz, who was traveling on northbound Ridgeley Drive. Guenthard claimed he injured his left arm and shoulder, and right eye and knee. Guenthard sued Schwartz and the owner of the vehicle, EAN Holdings LLC, which was operating as Enterprise Rent-A-Car Company of Los Angeles. Guenthard alleged Schwartz was negligent in the operation of her vehicle and that EAN Holdings was vicariously liable for her actions. Guenthard claimed that he was traveling straight on 8th Street, which was a thruway, while Schwartz was traveling straight on Ridgeley Drive, which was controlled by stop signs. He claimed that as a result, Schwartz failed to yield to oncoming traffic at the subject intersection and caused the broadside collision. The defendants did not argue liability for the accident., Guenthard was taken from the scene of the accident by ambulance and brought to an emergency room. He sustained a fracture of the left arm, a tear of the left rotator cuff and a sprained right knee. He also claimed multiple bodily contusions and a laceration to his right eye. Guenthard underwent open reduction and internal fixation on his left arm within one day of the accident. He also underwent several months of physical therapy to treat his shoulder and knee . Guenthard claimed the eye laceration caused nerve damage, resulting in permanent, partial loss of vision in his right eye. He also claimed he experiences residual aches and pains in his left arm and right knee. Guenthard further claimed that he has only been able to return to work in a limited capacity and that he is restricted from certain activities due to his partial vision loss, such as reading. As a result, he sought recovery of $280,000 in past medical costs and an unspecified amount of damages for his pain and suffering. Defense counsel did not dispute the severity of Guenthard’s .
