FACTS
On Feb. 6, 2012, plaintiff Pamela Wright, a mail carrier in her 40s, was delivering mail in a West Los Angeles neighborhood and was making a delivery to the house of Shery Catlett. At the same time, Catlett was on her cell phone while she was walking her dog with a retractable leash on the sidewalk in front of her home. After Wright made the delivery, she turned to go back to her mail truck, but Catlett’s dog, which had been released from the leash, took off running after Wright and bit her on her foot/ankle. Wright sued Catlett. She claimed that Catlett was negligent in the control of her dog. Specifically, Wright claimed that Catlett was careless and should have paid attention while she was walking her dog, instead of talking on the cell phone., Wright sustained a light, open wound to the back of her right foot and ankle area. She also sprained the big toe of her right foot when she attempted to escape the dog and stumbled. After the attack, Wright reported back to the post office and was sent to see the post office’s physician, who cleaned the wound. Wright did not require any surgery, but she claimed she had difficulty continuing on her mail route. As such, for two to three months, she was assigned light office duty and could not work overtime, as she had in the past. However, Wright is currently back to her normal duties. She was left with a small scar from the bite, but has otherwise healed.
