FACTS
On June 17, 2018, plaintiff Andy Davis, 31, was driving east on Lancaster Boulevard, in Lancaster. As he entered the intersection with Challenger Way, the driver’s side door of his sport utility vehicle was struck by the driver’s side front bumper of a sport utility patrol vehicle operated by Deputy Sheriff Jim Devoe, who was attempting to make a complete left turn from westbound Lancaster Boulevard onto southbound Challenger Way. The force of the collision caused Davis’ vehicle to deflect to the right and collide with a non-party compact vehicle that was stopped at a red light in the right-hand turn lane of northbound Challenger Way. Davis claimed to his neck and back. Davis sued Devoe and Devoe’s employers, the Los Angeles County Sheriff’s Department and the county of Los Angeles. Davis alleged that Devoe was negligent in the operation of his vehicle and that the Los Angeles County Sheriff’s Department and the county of Los Angeles were vicariously liable for Devoe’s actions while in the course and scope of his employment. Devoe initially denied liability, claiming that he was halfway through his turn when the collision occurred., Davis claimed he sustained soft tissue to his neck and back. He was transported from the scene by ambulance to Antelope Valley Hospital, in Lancaster, where he was treated and released three hours later. Davis underwent physical therapy and pain management for his alleged . Davis claimed his ultimately resolved, and he did not seek recovery of medical costs. Thus, Davis only sought recovery of damages for his pain and suffering. Plaintiff Rosa Johnson presented a derivative claim seeking recovery for her loss of consortium.
