FACTS
On the evening of March 31, 2011, the plaintiff, a 9-year-old girl, was at a friend’s house when a firepot exploded. The firepot looks like a vase and was intended to be used with refillable, pourable gel fuel alcohol. The explosion occurred as a result of more gel being filed into the firepot after the flame appeared to be extinguished. The girl sustained burns to 16 percent of her body. In June 2011, the manufacturer of the gel fuel ultimately agreed to recall the fuel after an investigation by the federal Consumer Product Safety Commission was initiated following dozens of similar incidents. The 9-year-old girl sued the homeowners, the products’ packager, and the products’ designers and distributors. Plaintiff’s counsel contended that the homeowners were negligent by failing to follow the products’ instructions. Counsel also contended that the firepot and gel fuel products were inherently defective. Counsel for the products’ defendants blamed the homeowners for causing the explosion. However, the homeowner defendants blamed the packager, designers and distributors, claiming the firepot and gel fuel products were defective., The 9-year-old girl sustained burns to 16 percent of her body, including burns to her hands, face, neck and legs. She was subsequently treated at a hospital for several weeks and had multiple graft procedures.
