From the statutory time period of Feb. 23, 2008, to Nov. 30, 2011, plaintiff Enrique Cardenas, who worked as a landscape maintenance foreman/supervisor for Dave Heyden Landscape, claimed that he was misclassified as an exempt worker and was not paid overtime wages. Cardenas sued the operators of Dave Heyden Landscape, David Lee Heyden and Sharon Heyden. Cardenas alleged that the defendants’ failure to pay him overtime constituted various violations of the California Labor Code., Cardenas sought recovery of overtime wages, penalties and other damages.
