FACTS
In the summer of 2003, the plaintiff, an 8-year-old boy, was sexually assaulted in the bathroom of the Fountain Valley-Kingston branch of the Boys & Girls Clubs of Huntington Valley. He claimed one incident occurred involving a 10-year-old boy. However, the plaintiff did not come forward about the incident until 2011, at age 16, when he told his father, who reported the matter to the police. The plaintiff, now 18, sued Boys & Girls Clubs of Huntington Valley Inc. He alleged the defendant negligently supervised the restroom where the assault occurred, since there had been a previous, similar assault in the same restroom three years earlier. Boys & Girls Club contended that its supervision was adequate and reasonable., The plaintiff claimed he suffers post-traumatic stress disorder, depression, and emotional distress as a result of being sexually assaulted. Thus, he sought recovery of general damages and future economic damages for his therapy.
