FACTS
On July 29, 2010, plaintiff Silvia Lozano claimed that East Palo Alto police officers trespassed upon her residence on Alberni Street in East Palo Alto. She claimed the officers surrounded and then entered her house with their guns drawn, and then broke down an interior bedroom door. Lozano sued the city of East Palo Alto for the alleged trespass of the police officers. She also alleged that the police officers obstructed and interfered with her freedom of movement in her residence and thereby falsely imprisoned her. Defense counsel contended that the incident was caused by Lozano’s own actions., Lozano claimed that she suffered severe emotional distress as a result of the police officers’ outrageous conduct. Subsequently, she claimed she incurred costs to obtain psychotherapeutic treatment. Defense counsel contended that Lozano did not sustain any injury as a result of the incident.
