On May 13, 2008, plaintiff Cassandra Vasquez, 47, a caretaker, was walking in the vicinity of a food display counter at the Cardenas Market in Colton when she allegedly slipped and fell in a puddle of water, her neck and back. Vasquez sued Cardenas Markets Inc. She alleged the defendant failed to maintain its premises, creating a dangerous condition, and that the defendant had notice of said condition. Vasquez claimed that the puddle most likely emanated from a large cooler bin in the area of her fall, which was filled with ice and beverages. She alleged that the bin was leaking, and that Cardenas should have been aware of the leak and the slipping hazard it created. Cardenas denied liability for the accident, alleging that it did not create a dangerous condition. It also denied Vasquez fell at the store and claimed that it had did not have any notice of a leak emanating from the cooler bin., Vasquez presented to a chiropractor with back and neck complaints 17 days after the accident. She subsequently began a course of chiropractic care that lasted six months. When her condition didn’t improve, she received two series of epidural injections to her neck. Vasquez claimed that while she dealt with pain, discomfort and restrictions during her recovery, she is now fully healed from her . Thus, she sought recovery of $50,000 in damages for her past medical costs and unspecified damages for her past pain and suffering. Defense counsel contended that if Vasquez did fall at the store, she did not sustain any serious injury. Counsel also contended that Vasquez’s treatment was unreasonable.
