FACTS
On Feb. 28, 2014, plaintiff Knarik Nazaryan, 57, an at-home mother, was exiting a store during a rainstorm when her upper body was struck by an outdoor umbrella that had been picked up by a strong gust of wind from a Quizno’s restaurant, located near the intersection of Ocean View Boulevard and Honolulu Avenue, in Montrose. Nazaryan sustained to her head, right shoulder and back. Nazaryan sued the operator of the Quizno’s restaurant, The Quizno’s Operating Company LLC, and the owner of that franchise location, Maroun Atallah. Nazaryan claimed that the defendants negligent left the restaurant umbrella outside, unattended, during a rainstorm when there were strong gusts of wind. She alleged that the defendants’ negligence created a dangerous condition., Nazaryan claimed that she suffered a headache and earache after the incident. She also alleged that she sustained to her right shoulder, and her mid- and upper back. Nazaryan subsequently underwent medical treatment for her condition. Nazaryan sought recovery of $15,550 in medical costs and an unspecified amount of damages for her pain and suffering.
