FACTS
On March 30, 2015, plaintiff Li Juan Huang, 80, was in a bathtub, getting ready to wash herself in her apartment at 701 West Newmark Avenue, an apartment complex in Monterey Park. However, when she turned the bathtub faucet on, it suddenly detached from the wall and caused the exposed pipe to spray scalding water all over Huang’s body. Huang subsequently screeched in pain as her husband, plaintiff Jun Lian Zhou, ran to her aid and tried to turn off the faucet and remove his wife from the tub. Huang sustained severe burn to her body. Huang sued the owners and property managers of the apartment complex, Monterey Park Garden LLC. Huang alleged that Monterey Park Garden failed to properly maintain the property, creating a dangerous condition. Ridan Inc. was also a named defendant, but it was ultimately dismissed from the case. Plaintiff’s counsel contended that Monterey Park Garden failed to maintain the property and appliances in a safe condition. Counsel also contended that Monterey Park Garden allowed the temperature of the water heating system to reach dangerously high levels that could cause, and did cause, serious scalding and burns., Huang sustained third-degree burns to her upper and lower extremities. She was subsequently transported by ambulance to Alhambra Hospital Medical Center, in Alhambra, where she was treated for her . Huang claimed that as a result of her burn , she has since suffered from respiratory difficulties and painful infections. Thus, she sought recovery of past and future medical costs, and damages for her past and future pain and suffering. Huang’s husband, Zhou, presented a derivative claim, seeking recovery for his loss of consortium. Zhou also asserted a claim of negligent infliction of emotional distress and also sought recovery for his own emotional distress.
