FACTS
On June 11, 2018, plaintiff Michael Ripley, 42, a musician, was driving a moped in the far left lane of I street, a three-lane one-way street in Eureka. When he entered the intersection with Eighth Street, he was struck by an extended cab truck operated by Jessalyn Jackson, who had turned left from the middle lane of Eighth Street. Ripley became caught under Jackson’s truck and was dragged 50 feet. Ripley sustained to his left leg and ankle. Ripley sued Jackson and the registered owner of Jackson’s truck, Alaris Cardoza. Ripley alleged that Jackson was negligent in the operation of her vehicle. Ripley further alleged that Cardoza was vicariously liable for Jackson’s actions. Ripley also sought recovery via the supplementary-underinsured-motorist provision of his own insurance policy, which was administered by Progressive Casualty Insurance Co. Independent witnesses agreed that Jackson was at fault for the collision., Ripley suffered severe, deep lacerations and debridement of the skin, muscle and tissue on his left leg and ankle.He was immediately taken by ambulance to a hospital. His became infected, and he required hospitalization and skin graft surgeries. After a prolonged rehabilitation, Ripley is now able to continue with his work and daily activities.
