FACTS
At various times between 2010 and Feb. 25, 2013, seven female plaintiffs, all minor students who attended Oak Grove Elementary School, within the Visalia Unified School District, were allegedly sexually assaulted by the school janitor, Antonio Cordova. The seven plaintiffs, through their respective guardians ad litem, sued the school district and Cordova. Plaintiffs’ counsel contended that the seven students, as well as others, individually and at different times, were taken into two different janitor’s supply closets, where they were sexually and/or inappropriately touched by Cordova. Counsel further contended that the molestation took place primarily in the janitor’s office, behind a closed, locked door. Thus, plaintiffs’ counsel asserted that Visalia Unified School District employees should have reported their suspicions and the multiple incidences to the proper authorities, but failed to do so. Counsel asserted that if Cordova was reported earlier, the molestations of each of the seven plaintiffs would have been prevented. Visalia Unified School District denied having any prior notice of Cordova’s alleged conduct., The seven minor plaintiffs were all sexually assault, and most of them developed post-traumatic stress disorder as a result of the incidents. They claimed that they continue to experience flashbacks, nightmares, hypervigilance, and exaggerated startled responses. The plaintiffs’ treating therapists claimed that the sexual abuse the girls endured will be carried with them for a long time. The therapists alleged that the girls will continue to struggle with issues and manifested symptoms for many years to come.
