FACTS
On May 24, 2010, plaintiffs Ryan Ancheta and Erica Villarta were stopped in a vehicle on westbound State Route 60 in Diamond Bar, as there was an accident ahead of them involving vehicles driven by Connie Martinez and Humberto Velasco. Ancheta was driving and Villarta was in the front passenger seat. Their vehicle was ultimately rear-ended by a vehicle. Ancheta and Villarta then got out of their vehicle and were struck by another vehicle. Finally, a yet another vehicle approached the scene and crashed into the vehicles in front of it. Ancheta and Villarta sustained multiple during the incident. Ancheta and Villarta sued the drivers involved in the initial accident, Connie Martinez and Humberto Velasco; the owner of Velasco’s vehicle, Jose Molina; Martinez’s passenger, Leo Castillo; the driver that was believed to have rear-ended Ancheta and Villarta, Michelle Gonzales; the co-owner of Michelle Gonzales’ vehicle, Teodoro Gonzales; the final driver on the scene that crashed, Luis Magana Hernandez; and two other parties involved in the multiple-vehicle collision, Alan Spencer and Xiao-Ling Zhang. Velasco and Molina were ultimately dismissed from the case earlier on since he was the first car involved and the parties didn’t believe that his vehicle caused the accident. Spencer was also dismissed early on, and Martinez and Castillo were unrepresented. Ancheta and Villarta alleged that Ms. Gonzales, Hernandez, and Zhang were negligent in the operation of their respective vehicles. They also alleged that Mr. Gonzales was vicariously liable for Ms. Gonzales’ actions. Ancheta and Villarta claimed that while they were stopped for the initially accident, Ms. Gonzales rear-ended them. They also claimed that Zhang then struck them after they exited their vehicles and that Hernandez caused additional harm by striking the vehicles in front of him. Ms. Gonzales initially claimed one of the other drivers contributed to the accident. Zhang contended she did not hit anyone in the accident. Counsel for the estate of Hernandez contended that Hernandez’s vehicle came last and that it likely did not hit Ancheta or Villarta., Ancheta suffered two trans-scaphoid perilunate , fibula fractures to both legs, fractures of the 9th and 10th ribs on the left side, and a left transverse process fracture. He subsequently went to the University of California, Irvine Medical Center (UCI Medical Center), in Orange, and underwent surgeries to his left wrist and both legs. Ancheta then had another surgery to take the pins out of his wrist. Ancheta’s medical expenses amounted to approximately $60,000. He still has metal hardware in the lower parts of each arm as a result of surgery. Villarta suffered a fracture of the right pelvis; an abscess in the upper, right thigh; a blood clot in the upper, right thigh; lacerations on the right side of the chest; and a hematoma in the right thigh. She was subsequently treated at Los Angeles County+University of Southern California (LAC+USC) Medical Center in Los Angeles. During her recovery, Villarta developed cellulitis, a bacterial infection, of the right thigh. The abscess in her right, upper thigh later became a hole and she is now left with a permanent dent/deformity there. In addition, Villarta was left with permanent scarring on her abdomen and pelvis, and hypertrophic scars. She claimed her medical expenses amounted to approximately $161,000.
