FACTS
On Oct. 22, 2015, plaintiff Rupal Shah, 45, an independent editor, was driving in San Anselmo. When she reached the intersection of Sir Francis Drake Boulevard and Barber Avenue, her vehicle was rear-ended by a vehicle operated by Austin Alders. Shah claimed to her back. Shah sued Austin Alders and an owner of Mr. Alders’ vehicle, Laura Alders. Shah alleged that Mr. Alders was negligent in the operation of his vehicle and that Ms. Alders was vicariously liable for Mr. Alders’ actions. The Alders admitted liability for the accident., Shah claimed that she suffered sprains and strains of her lower back and a herniated lumbar disc. She claimed that she needed a lifetime of radiofrequency ablation procedures to address her continuing back complaints. Shah sought recovery of damages for past and future pain and suffering. Defense counsel asserted that the procedures alleged by Shah were not reasonable or necessary, and that they were not related to the subject accident.
