FACTS
In 2006, claimant Flint Paul, a police sergeant for the San Francisco Police Department, explained to the department that he was transgender, and requested to be called by his chosen name and appropriate male pronouns. However, he claimed that over the next 14 years, he was repeatedly harassed by multiple superior officers at work, who called him by his former name and/or with female pronouns. Paul also claimed that, on multiple occasions, his superiors "outed" him in front of other colleagues who were unaware of his transgender status, including on the police department radio and at public settings. Paul brought harassment claims against his employer, the City and County of San Francisco, and the parties reached a settlement in 2012. However, Paul claimed that despite the settlement and transferring to a different police station within the city, multiple superior officers continued to call him by his former name and/or with female pronouns. In May 2017, Paul filed multiple new claims against the City and County of San Francisco with the San Francisco Department of Human Resources and the U.S. Equal Employment Opportunity Commission. Paul alleged that the city’s actions constituted unlawful harassment and failure to prevent harassment on the basis of sex, gender, gender identity and gender expression under Government Code § 12940 and in violation of California’s Fair Employment and Housing Act., Paul was employed with the San Francisco Police Department, and by the City and County of San Francisco, since April 17, 1995, first as a Q2 Police Officer and then, beginning on June 22, 2013, as a Q052 Sergeant III. However, he claimed he suffered emotional distress from the years of unlawful harassment. Paul sought recovery for his emotional pain and suffering.
