FACTS
On May 15, 2011, plaintiff Hung Ly, 57, tripped and fell over some boxes on the stairs in the common area of a property in Alhambra she was renting from owner Trinh Le. Ly claimed facial after falling face-first on the stairs. Ly sued Le, alleging the defendant failed to properly maintain the area, creating a dangerous condition. She claimed that there was insufficient lighting for her to see the cardboard boxes as she walked on the stairs. Le claimed that the lighting was sufficient, and that the boxes were an open and obvious hazard., Ly was driven to the hospital, where she was determined to have suffered a fractured orbital bone, a concussion and significant lacerations to her face. She was given in excess of 200 stitches to her face and underwent surgery to repair the fractured orbital bone. Ly was ultimately hospitalized for about five days. Ly claimed that she has some minor scarring on her face and other scarring that is covered by her hairline. She also alleged that as a result of her concussion, she has some lingering memory problems and headaches.
