Plaintiffs Robert Nigg and Keith Lewis, as well as other current and former postal inspectors, claimed that during their employment with the United States Postal Service, they were not paid the appropriate overtime wages. Nigg and Lewis, on behalf of themselves and all others similarly situated, filed a class action lawsuit against the Postal Service. They alleged that the defendant violated the Fair Labor and Standards Act. The class claimed that the Postal Service improperly classified them as exempt employees and did not pay them their entitled to overtime wages pursuant to the Fair Labor and Standards Act. Counsel for the class argued that frontline postal inspectors were not covered by any of the exemptions to the Fair Labor and Standards Act overtime provisions because the “public safety employee” provisions of § 29 C.F.R. 541.3(b) removed all frontline law enforcement employees from the operation of any of the exemptions as a matter of law. Defense counsel argued that the class was exempt from the Fair Labor and Standards Act overtime provisions under the administrative exemption. Counsel also argued that § 541.3(b) was inapplicable because postal inspectors were administratively exempt from the overtime protection of the Fair Labor and Standards Act., The class sought recovery of damages for all overtime wages owed under the Fair Labor Standards Act and not paid within the applicable statute of limitations. The class also sought recovery of attorney fees and liquidated damages.
