In February 2018, plaintiff Ernie Flores, who was a school principal for the Palo Verde Union School District, was terminated from his position. One month before his termination, Flores complained to the school board that it discriminated against a school board applicant based on the applicant’s race. Flores claimed that he was also given anonymous letters from the school board that included complaints about him, which included comments such as, “This is America,” “Don’t speak Spanish,” and “Don’t play Spanish music.” Shortly after filing his compliant, Flores was fired. Flores sued the Palo Verde Union School District, alleging that the school district’s actions constituted discrimination and whistleblower retaliation. Flores claimed that he spoke Spanish to students and played Latin music throughout the day during his breaks and that the letters he was provided was proof that the school board discriminated against him based on his national origin. He also claimed that he was terminated in retaliation for filing a complaint about the school board’s perceived discrimination against another person applying for a school board position based on that person’s race. Defense counsel contended that Flores was terminated for performance reasons and because the school board lost trust in him. Counsel denied that Flores was discriminated against, and contended that his termination had nothing to do with him speaking Spanish to the students., Flores claimed that he suffers from emotional distress as a result of the incidents. He also claimed that he had to switch careers after his termination and that he began a career in real estate. However, he alleged that he does not earn what he used to. Flores maintained that he underwent counseling for his emotional distress and that he could need future counseling. The plaintiff’s economics expert opined that Flores’ past loss of earnings totaled $324,686 and that Flores’ future loss of earnings would total $1,488,190. Flores sought recovery for his past and future loss of earnings, and past and future emotional pain and suffering. The defense’s economics expert disputed the numbers that the plaintiff’s expert provided for Flores’ alleged loss of earnings.
