Since June 2009, plaintiffs Sun Byun, Ju Hun Min and Hyub Choi, all of who worked at a printing press for Joong-Ang Daily News California Inc., a newspaper company that published different newspapers, allegedly worked overtime. However, they claimed they were not paid for the overtime hours worked. They also claimed that they worked long hours and that Byun and Min were misclassified as managers (team leaders). In addition, they claimed that they were not provided meal or rest breaks and that, ultimately, they were wrongfully discharged on Aug. 15, 2013. Byun, Min and Choi sued Joong-Ang Daily News California Inc. and Joong-Ang Media Network USA Inc. Byun, Min and Choi alleged that the defendants’ actions constituted violations of the Labor Code and the Business & Professions Code. They also alleged that they wrongfully discharged in violation of public policy. Byun’s case was the lead case, and Min and Choi’s cases were consolidated with Byun’s initial action. Joong-Ang Media Network USA Inc. was dismissed as a defendant during trial. Thus, the trial continued against Joong-Ang Daily News California Inc. only. Byun, Min and Choi claimed that they were not paid for the overtime hours worked since around the 2000s, but that they had to limit their claims to the period between June 2009 and their termination on Aug. 15, 2013. Byun and Min alleged that they were marked as exempt from receiving overtime due to being misclassified as team leaders, but that they were actually not exempt from overtime wages. Defense counsel contended that the plaintiffs’ claims were unreasonable, that the plaintiffs received both meal and rest breaks, and that the company had adequate records of the hours worked, which showed that no overtime was worked., Byun, Min and Choi sought recovery of unpaid wages for the alleged overtime hours worked, for the alleged wrongful termination, and as compensation for the meal and rest breaks that they were allegedly not provided. They also sought recovery of damages for the alleged violations of the Labor Code and the Business & Professions Code.
