Plaintiff Carlos Herrera, 40, a prisoner at Kern Valley State Prison, claimed that he suffered liver damage as a result of being denied medical treatment by correctional officers and physicians at the prison. Herrera sued S. Lopez, L. Bluford, Dill, C. Hall, G. Moonga, S. Zamora, Dr. Turella, Dr. Penner and N. Grannis. He alleged that the defendants’ violated his civil rights by denying him medical treatment. The trial ultimately continued only against Lopez, a contract physician with the California Department of Corrections and Rehabilitation and the Chief Medical Officer at Kern Valley State Prison since 2007. Herrera claimed that Lopez’s deliberate indifference was in violation of his Eighth Amendment rights. Defense counsel contended that Herrera’s alanine aminotransferase level, which is the chemical that the liver secretes when damaged, were elevated to less than two times normal laboratory values for three consecutive AL tests performed. Thus, counsel asserted that Herrera did not qualify for combination therapy for treatment of Hepatitis C and that the plaintiff did not suffer liver damage due to any alleged delay in providing combination therapy., Herrera claimed he sustained liver damage as a result of being denied treatment. Defense counsel contended that Herrera did not sustain any liver damage.
