In June 2010, plaintiff Shaen Isayan, entered into a written agreement with Levon Isadzhanyan, who was doing business as LSI General Engineering & Construction Co., for a construction project to demolish and rebuild Isayan’s existing single-family home in Burbank. Isayan and Isadzhanyan had an initial estimate, before both agreeing to some changes, for a total project cost of roughly $84,000, to be paid incrementally. The project commenced that same month, beginning with the demolition of the existing structure. However, in July 2010, LSI stopped work on the project, which was roughly two-thirds through completion. At that point, Isayan had paid Isadzhanyan $66,400 for the work. Isayan sued Isadzhanyan, who was doing business as LSI. He alleged that the defendant’s actions constituted a breach of contract, unjust enrichment and fraud. The matter proceeded to a bench trial. Isayan claimed that the defendant refused to continue working on the project due to a payment dispute, in which Isadzhanyan wanted more money than what was included in the written agreement. Isadzhanyan claimed that Isayan didn’t let LSI continue the project due to issues at the job site, and that he was asked to leave by the plaintiff. Isadzhanyan subsequently filed a cross-complaint against Isayan for breach of contract., Isayan claimed that he was overcharged by Isadzhanyan for the work already done on the project, and sought repayment of this sum, plus $2,000 for property damage to the sidewalk in front of his home, as well damages for the remainder of the project’s cost and repairs. In total, Isayan sought recovery of $9,000 in damages. Isadzhanyan sought recovery of damages for the materials and goods purchased for the project and used in the work, but for which Isayan had not paid him. Thus, he alleged damages of roughly $19,000.
