FACTS
On Dec. 7, 2012, plaintiff LaRayne Lockwood, 44, an executive assistant, was driving her 2010 Toyota Prius in the far left, number one, lane of northbound Ventura Freeway, also known as Highway 101, in Camarillo, when she applied her breaks to stop for traffic ahead of her. As she came to a complete stop south of the intersection with Pleasant Valley Road, Lockwood was rear-ended by a Ford Taurus operated by Julie Webb. Lockwood claimed she injured her neck in the crash. Lockwood sued Julie Webb and the owner of Ms. Webb’s vehicle, Michael Webb. Lockwood alleged that Ms. Webb was negligent in the operation of her vehicle and that Mr. Webb was vicariously liable for Ms. Webb’s actions. Plaintiff’s counsel contended that Ms. Webb was traveling at an unsafe speed and was unable to stop in time, causing the rear-end collision. Counsel noted that Ms. Webb’s car had to be towed from the scene., Lockwood claimed that she sustained a cervical disc herniation at the C5-6 level, resulting in neck pain and radiculopathy. She ultimately underwent a cervical incision surgery and 12 weeks of physical therapy. Lockwood claimed that she eventually had improvement to her neck’s range of motion. However, she claimed she can no longer sit for more than 15 minutes at a time due to excruciating pain between her shoulder blades. She alleged that as a result, she treats her pain with weekly massage therapy treatments.
