FACTS
On Jan. 16, 2010, plaintiff Paul Wang, 30, a student, was driving his vehicle on Clark Avenue in Long Beach, with plaintiff Jonathan Blankenship, 19, a student, as a passenger. Their vehicle was ultimately rear-ended by a vehicle operated by Lorenzo Corpos. Wang and Blankenship both claimed neck and back from the crash. Wang and Blankenship sued Corpos. They alleged that Corpos was negligent in the operation of his for vehicle., Later on the day of the accident, Wang and Blankenship brought themselves to an emergency room with complaints of neck and back pain. They were each diagnosed with soft-tissue neck and back , and followed up with a chiropractor for two months of treatment. Wang and Blankenship each claimed they had ongoing problems despite, including stiffness and discomfort, despite undergoing chiropractic treatment. Wang ultimately underwent a nerve root block in 2011. Defense counsel argued that the alleged of both Wang and Blankenship had resolved following their initial chiropractic treatment. The defense’s expert chiropractor opined that neither Wang nor Blankenship would require any future treatment. According to defense counsel, the plaintiffs’ treating chiropractor also opined that Wang and Blankenship were asymptomatic after treatment.
