FACTS
At around 6 a.m. on June 10, 2014, plaintiff Stephanie Cardoza, 41, a senior credit analyst and office administrator, was walking in the parking structure of an apartment complex where she resided, in Covina, when she slipped and fell. Cardoza claimed she injured her lower back. Cardoza sued the property owner, Cypress Village Condos, LLC, alleging that Cypress Village failed to properly maintain the parking structure, creating a dangerous condition. Cardoza claimed she slipped and fell on a greasy, oily stain on the cement flooring of the garage. Plaintiff’s counsel contended that the oily stain had been present for some time and been the subject of conversations between Cardoza, Cypress Village’s representatives, and other tenants. Thus, counsel asserted that Cypress Village knew of the slippery condition prior to the subject incident, but failed to timely address the issue. Defense counsel contested liability, asserting that it was the other tenants’ responsibility to clean up the oil stain., Cardoza claimed that she suffered a large lumbar disc herniation at the L4-5 level with right-sided radiculopathy. She also claimed she suffered lumbar stenosis and sciatica. Cardoza subsequently presented to a hospital emergency room on the day of her fall. She ultimately underwent lumbar surgery; epidural injections; and extensive, three-month-long physical therapy. Cardoza claimed that she had to take off approximately three months of work as a senior credit analyst and office administrator to pursue her medical treatment and rehabilitation. She also claimed that she could not attend to her four children as well as she had before the subject incident and that she continues to have work and life restrictions, such has not being able to sit or stand for extended periods of time. Defense counsel contended that Cardoza’s back condition and symptomology were pre-existing due to her work and not caused by the alleged slip and fall. Counsel also challenged the reasonableness and necessity of Cardoza’s medical treatment, which included surgery and extensive rehabilitation.
