In 2009, a teenage female hostess working at Sal’s Mexican Restaurant in Fresno was allegedly sexually harassed by a male supervisor. The restaurant hostess claimed the sexual harassment and discrimination continued until she was ultimately forced to resign in 2010. The former hostess filed a sexual harassment discrimination charge with plaintiff the U.S. Equal Employment Opportunity Commission, which ultimately found a reasonable cause to believe that the restaurant violated Title VII of the Civil Rights Act of 1964 for the alleged sexual harassment, intimidation, discrimination and constructive discharge to which the hostess was subjected due to her gender. Thus, the EEOC brought a claim against Sal’s Mexican Restaurant. The former hostess claimed that her boss made unwanted sexual propositions and advances, grabbed her body parts and tried to kiss her. She also claimed that her boss required her to give hugs and back rubs as a condition of her employment due to her gender. The hostess contended that she made repeated complaints to restaurant management about the behavior, but that her complaints were not addressed. She alleged that as a result, she felt compelled to resign in 2010., The EEOC sought recovery of compensatory damages for the former teenage hostess.
