FACTS
On Aug. 22, 2015, plaintiffs’ decedent Christopher Rodriguez, 16, a student, was a passenger in the right, front seat of a sports vehicle operated by his brother, plaintiff Nicholas Rodriguez, 22. When they were approximately two miles south of Spunky Canyon Road, traveling southwest on Bouquet Canyon Road, in an unincorporated area of Los Angeles County, near Santa Clarita, Nicholas Rodriguez lost control of his vehicle. The vehicle spun, and the right side struck a tree bordering the roadway. Christopher sustained traumatic from the impact and died at the scene, while his brother sustained to his head and chest. Nicholas Rodriguez and Christopher’s parents, Ed Rodriguez and Nancy Rodriguez, acting individually and on behalf of Christopher’s estate, sued the county of Los Angeles, which controlled and maintained both Bouquet Canyon Road and the subject tree. Plaintiffs’ counsel contended that the road was left in a dangerous condition, as there was no guardrail to prevent a vehicle from colliding into a tree. Defense counsel contended that Nicholas Rodriguez was negligent for driving at an excessive speed. Counsel also contended that there was no dangerous condition and that if there was, the county had no notice of it because there had been no prior accidents at the subject location. However, according to plaintiff’s counsel, six months after the Rodriguez accident, a young woman went off the road at the same location and died., Christopher sustained multiple traumatic and was pronounced dead at the scene. Christopher’s parents sought recovery of wrongful death damages for the loss of Christopher. Christopher’s brother, Nicholas Rodriguez, sustained facial fractures, a concussion and rib fractures.
