On Aug. 2, 2016, plaintiff Hiba Lai, a clinical therapist for the Coachella Valley Unified School District, was terminated from her position. Lai was hired by the school district in June 2015. She was set to start work in August 2015, but one month before, she learned that she was pregnant. Lai informed the district about her pregnancy in July 2015 and then informed her supervisor on her first day of work. Lai claimed that over approximately the next six months, she was harassed by her supervisor and not provided accommodations for her pregnancy, so she filed an internal complaint with the district. She then went out on doctor-ordered maternity leave, which last the rest of the 2015-16 school year. When Lai attempted to return to work at the start of the next school year, she discovered she had been terminated from her employment. Lai sued the Coachella Valley Unified School District, alleging that the district’s actions constituted a failure to accommodate, discrimination, harassment and retaliation. Lai claimed that her employer discriminated against her based on her pregnancy and that she was not provided accommodations during her pregnancy. She also claimed that she suffered verbal abuse from her supervisor and that nothing was done when she filed a complaint with human resources. In addition, she claimed that the school district retaliated against her for filing the complaint. Defense counsel contended that Lai was still in her probationary period when she was terminated for not performing her job properly., Lai claimed she could not find employment after her termination, causing her to suffer a loss of earnings. She claimed that as a result, she eventually opened up her own clinical therapy practice. Lai also claimed that she suffers from emotional distress as a result of the subject incidents and that she underwent psychological treatment for her condition. Lai sought recovery for her past loss of earnings, and for her past and future emotional distress.
