Beginning in 2002, nine minor plaintiffs, most of whom were former football players at Benjamin Franklin High School, allegedly became victims of sexual misconduct by Jaime Jimenez, a volunteer football coach at the school. Jimenez’s misconduct was alleged to have occurred at various times at his home and other off-campus locations until 2015. In 2016, Jimenez, then 50, was sentenced to more than 36 years in state prison after pleading no contest to abusing three of the high school students. The plaintiffs filed four separate suits against Jimenez, Los Angeles Unified School District, Benjamin Franklin High School, and Glendale Junior All American Football Association Inc. The matters were consolidated. However, the plaintiffs, all of whom were adults by the time the lawsuits were filed, dismissed Jimenez from the case. Benjamin Franklin High School was also dismissed, and the claims of Maria de Jesus Torres Diaz and Edgar España, who was acting as a guardian, were both dismissed with prejudice on demurrer. The matter continued with the “Doe” plaintiffs’ claims against the school district and the football association. Plaintiffs’ counsel contended that Jimenez gave students rides from practice, bought them gifts and regularly invited them to his house, where he sometimes plied them with alcohol. Counsel further contended that district administrators ignored several red flags about Jimenez’s behavior, including secluding students in equipment and locker rooms, giving the students rides in his car, and taking photos with the students. Defense counsel disputed the allegations, asserting that the school district and the football association did not know or have any reason to know that Jimenez presented a risk to students., The plaintiffs claimed they suffer from emotional distress as a result of the sexual assaults from Jimenez. They continue to undergo counseling and therapy for their alleged emotional distress. The plaintiffs sought recovery of past and future medical costs for their counseling and therapy. They also sought recovery of non-economic damages for their alleged past and future pain and suffering.
