Between Oct. 16, 2004, and Aug. 16, 2011, plaintiff Mian Alam worked as an hourly security guard for Hawks International Security Inc. Alam, who was in his 50s in 2011, claimed that during the period of his employment, he was not given meal breaks or rest periods, and was not paid any of the overtime or double overtime wages that he was entitled to. Alam also claimed the company kept no wage or hour statements. Alam sued Hawks International Security Inc., alleging that the defendant’s actions constituted violations of the Labor Code. Defense counsel argued that Alam failed to prove he worked overtime or double overtime. Counsel also argued that Alam was provided with meal breaks and rest periods and that Alam left employment with Hawks International Security without any complaints., Alam sought recovery for the missed meal breaks and rest periods, and sought recovery for the unpaid overtime and double overtime wages during his employment with Hawks International Security. However, in accordance with California law, Alam could only claim four years of past wages and fees for meal breaks and rest periods.
