In 2012, plaintiff Dana Camarillo, 36, a police sergeant with the county of Los Angeles, applied for an open position to be a liaison between the county and the city of Hawaiian Gardens, as the county provided police enforcement for the city. However, Camarillo claimed she was denied the position because she was not male or born in Mexico. She also claimed that when she complained, she was moved to a less promotable track in the sheriff’s department. Camarillo sued the county of Los Angeles and the city of Hawaiian Gardens, alleging that the actions of the county and the city constituted gender discrimination and retaliation. The city of Hawaiian Gardens was ultimately dismissed from the case. The county originally obtained summary judgment, but the decision was later reversed on appeal. Camarillo’s counsel claimed that Camarillo was highly qualified, but that when Camarillo asked her female captain about the open position, the female captain told Camarillo that she could not give her the position because the mayor of the city of Hawaiian Gardens only wanted the position to be filled by a male who was born in Mexico. Camarillo claimed that when she complained about what she was told, her female captain moved her from the patrol track in the sheriff’s department, which would provide her the ability to be promoted, to the jails track in the sheriff’s department, where Camarillo would not be able to be promoted, even though Camarillo was already on the patrol track prior to her complaints. The county disputed Camarillo’s claims., Camarillo claimed that when she was transferred to the jail track and worked at the men’s central jail, she contracted a grave illness, which ultimately incapacitated her and forced her into an early retirement. She also claimed she suffers from emotional distress as a result of the events. Camarillo sought recovery for her past and future loss of earnings, and past and future emotional pain and suffering.
