FACTS
On April 6, 2017, plaintiffs’ decedent Gilbert Aceves, 54, was involved in an altercation with his brother, Luis Aceves. The fight took place at their mother’s former residence on the 2200 block of Marco Drive in Camarillo. Luis Aceves, who had threatened Gilbert Aceves in the past, allegedly grabbed a Samurai sword and stabbed his brother numerous times. Gilbert Aceves died later that day. The decedent’s five other siblings — Robert Aceves, Leon Aceves, Joe Aceves, Lupe Aceves and Mary Lou Aceves — sued Luis Aceves, alleging that Luis Aceves’ intentional act was malicious and oppressive. Luis Aceves initially fled the state, but he was eventually arrested and charged with murder. His criminal trial was still pending at the time of the civil trial. As a result, Luis Aceves defaulted on the civil lawsuit, and the matter proceeded to a bench trial that solely addressed the plaintiffs’ damages., Gilbert Aceves sustained numerous stab wounds. He was placed in an ambulance and transported to an emergency room. He was pronounced dead a short time later on April 6, 2017. He was 54 years old. In addition to the brother that allegedly caused his death, the decedent was survived by three other adult brothers (Robert Aceves, Leon Aceves and Joe Aceves) and two adult sisters (Lupe Aceves and Mary Lou Aceves). The decedent’s siblings each testified that their Gilbert Aceves was always there to help them whenever they needed it. They sought recovery of funeral expenses along with damages for their loss of society and companionship, loss of future contributions, and loss of personal service, advice and training.
