From 2009 to 2010, the plaintiff, 9, a fourth-grade special education student, attended an after-school program at a Los Angeles Unified School District elementary school. During this period, she was sexually assaulted five times by a 10-year-old male student on campus at the after-school program. The plaintiff sued the Los Angeles Unified School District (LAUSD), alleging negligent supervision. On the eve of trial, LAUSD admitted to liability, and the matter proceeded to a trial on damages only. , The plaintiff claimed she suffers from post-traumatic stress disorder and anxiety resulting from the sexual assault. She sought $81,250 in damages for future therapy costs as well as damages for her pain and suffering. LAUSD contended that the girl had done well with therapy and that she showed few signs that the incidents were still affecting her at the time of trial, three years after the incidents.
