From 2009 to 2010, the plaintiff, 9, a fourth-grade special education student, attended an after-school program at a Los Angeles Unified School District elementary school. During this period, she was sexually assaulted five times by a 10-year-old male student on campus at the after-school program. The plaintiff sued the Los Angeles Unified School District (LAUSD), alleging negligent supervision. On the eve of trial, LAUSD admitted to liability, and the matter proceeded to a trial on damages only. , The plaintiff claimed she suffers from post-traumatic stress disorder and anxiety resulting from the sexual assault. She sought $81,250 in damages for future therapy costs as well as damages for her pain and suffering.
