FACTS
In April 2007, intervening plaintiff Deisy Mora, 19, a sales person and assistant manager, was hired by WirelessComm Inc., a distributor for Metro PCS. She claimed that since the time of her hiring, she was subjected to ongoing sexual harassment by a store manager. Mora claimed that as a result of the hostile and abusive work environment, she felt that she was ultimately forced to quit in October 2007. Mora subsequently filed a claim with plaintiff Equal Employment Opportunity Commission, which investigated the allegations and attempted to reach a voluntary settlement with WirelessComm. When initial settlement talks failed, the EEOC sued WirelessComm Inc. for violations of Title VII of the Civil Rights Act of 1964. Mora subsequently intervened and filed suit against WirelessComm Inc.; the store owner, Lahouari Aribi; and the store manager, Karim Hadid. She alleged the defendants violated Title VII and the California Fair Employment and Housing Act. Mora claimed Hadid frequently commented about her physical appearance, texted her, “Te quiero,” or “I love you” in Spanish, and sent photos of himself. She also claimed that Hadid referred to women in general with slurs and epithets. In addition, Mora claimed that Aribi contributed to the harassment by inviting her to travel with him, asking her and others if they were pregnant, and, on one occasion, asking her to text photos of herself and other female staff members., Mora, who was a teenager at the time of the incidents, claimed emotional distress, causing an impact on her self-esteem. Thus, she sought monetary damages, including back pay, compensation for her emotional distress, and punitive damages. She also sought an injunction to prevent further discrimination.
