FACTS
During the 2009 to 2010 school year, the plaintiff, a middle school student, claimed he was bullied by his classmates. He claimed the bullying went on for several months and consisted of mostly of verbal taunts that were anti-gay and anti-Semitic in nature. Eventually the administration learned of the bullying when female classmates reported that they were concerned for the plaintiff’s well-being. The school conducted an investigation and disciplined the bullies. However, during the investigation, the plaintiff attempted suicide in the school bathroom. The plaintiff sued the school. He alleged that the school failed to adhere to its anti-bullying policy, which was supposed to include a “zero tolerance” approach toward bullying. The school claimed it acted appropriately as soon as it learned about any alleged bullying, in that it conducted an investigation and disciplined those involved., The plaintiff claimed severe emotional distress and depression as a result of the incidents, causing him to attempt suicide in the spring of 2010. He was subsequently in therapy for two years after the incident and claimed past medical costs of $50,000 for his therapy. The defendant asserted that the plaintiff took an active part in the teasing of other boys and that he had other issues in his life that were the cause of his emotional problems.
