FACTS
In July 2010, during a wrestling practice at Buchanan High, the plaintiff, a freshman, alleged that his teammate illegally executed a wrestling move called a “butt drag,” in which the teammate allegedly rammed two fingers up the plaintiff’s anus in an attempt to humiliate and bully him. The plaintiff sued Clovis Unified School District for negligent supervision. He claimed that he was unwilling and that the teammate sexually assaulted him by executing the move. The plaintiff alleged that, when done legally and with proper technique, the move involves a wrestler intensely grabbing their opponent’s butt cheek to obtain leverage and better positioning. He claimed, however, when the improper move was done, the school failed to intervene. The teammate claimed he was doing a legitimate move. However, the teammate was ultimately expelled., The plaintiff told Clovis police and school officials that the teammate sexually assaulted him in an attempt to humiliate and bully him. Thus, he claimed he suffered physical and emotional pain from the incident.
