On Sept. 9, 2010, plaintiff Brandon Felczer began work as a retail specialist for Apple Inc. He worked with the company until Nov. 23, 2011. During that time, plaintiffs Ryan Goldman and Ramsey Hawkins also worked as retail specialists for Apple, while plaintiff Joseph Carco worked in the corporate side of Apple. They alleged that during the time of their employment, Apple failed to allow them to take their required meal and rest breaks. They also alleged that Apple delayed sending them their final paychecks. Felczer, Goldman, Hawkins and Carco, acting individually and on behalf of a class of similarly-situated persons, sued Apple, alleging violations of California’s Labor Code. Specifically, they alleged that Apple violated meal and break time laws, as well as delayed sending final paychecks to workers who had given their notice. In July 2014, San Diego Superior Court Judge Ronald Prager certified a class of approximately 20,000 Apple employees in the suit, including six subclasses, which included a meal-break class and rest-break subclass (each for retail and corporate employees), a waiting-time-penalty subclass, and a wage-statement subclass. The claims were from Dec. 16, 2007 through July 31, 2012. Plaintiffs’ counsel contended that Apple had a corporate policy that did not allow workers to discuss labor conditions at work. Counsel asserted that the policy added to an atmosphere of fear among workers that perpetuated violations and kept anyone from reporting those violations. Defense counsel contended that Apple’s policies and practices were lawful and correctly stated the law., The class of approximately 20,000 Apple employees claimed that they were entitled to an extra hour for all rest and meal periods missed. Thus, they sought recovery of damages based on the missed meal and rest periods, which were violations of Labor Code §§ 510 and 226.7.
