FACTS
On June 13, 2012, plaintiff Kerbi Urbanowski, 21, a nanny, was at the residence of Jason Marandas and his wife, Tiffany Marandas, on Jackson Street in San Francisco. Urbanowski claimed that she was shot in the right eye by an arrow from a crossbow fired by Mr. Marandas. Urbanowski sued Mr. and Mrs. Marandas. Urbanowski alleged that Mr. Marandas was negligent in the handling of the crossbow and that both defendants were liable for the dangerous condition created by having the weapon. Plaintiff’s counsel contended that the defendants should not have had a crossbow within city limits. Counsel also contended that Mr. Marandas should have warned Urbanowski that the crossbow had previously misfired and should have helped Urbanowski receive medical treatment after he injured her. Mr. and Mrs. Marandas admitted liability., Urbanowski’s cornea was lacerated when she was struck with the crossbow arrow. She ultimately underwent two surgeries to repair the tear, but she claimed she could not see for approximately six months after the accident and had to be cared for by family members. Urbanowski, now 23 and an artist, claimed she continues to have vision problems. She also claimed that she had to drop out of college for a semester while she recovered. Defense counsel disputed the scope of Urbanowski’s damages.
