FACTS
On March 17, 2019, plaintiff Paul Vinson, 61, an actor and stuntman, was walking along Pacific Beach, in San Diego, when a dog lunged out and attacked him. Vinson punched the dog in an attempt to prevent it from biting him and sustained to his right hand. Vinson sued the believed owner of the dog, Dralia Marin, alleging that Marin was strictly liable for the dog’s actions. Marin did not appear at trial., Vinson sustained a fracture of a metacarpal of his right, dominant hand. He presented to UC San Diego Health’s Jacobs Medical Center, in La Jolla, where his fractured hand was placed in a cast. Vinson claimed there he had an acting opportunity that he could not do because the set would not allow him to perform the job because of his injury. He also claimed that he suffered emotional distress as a result of the accident and his missed acting opportunity. Vinson sought recovery of past medical costs and damages for his past and future emotional and physical pain and suffering.
