FACTS
In 2013, plaintiff Julia Frost, a non-closeted lesbian and an English teacher at Sultana High School, in Hesperia, was told her employment contract would not be renewed for the 2013-14 school year. Frost sued the operator of the high school, the Hesperia Unified School District. She alleged that the school district’s actions constituted sexual orientation harassment, discrimination and retaliation in violation of California’s Fair Employment and Housing Act, and related causes. Frost claimed that she was subjected to discrimination and harassment because of her sexual orientation since she started at Sultana in August 2011. She helped members of Sultana High School’s Gay Straight Alliance club — which she co-sponsored — bring in the American Civil Liberties Union of Southern California to address what she and students saw as alleged discrimination against gay students and club members by teachers and administrators in 2012. Frost claimed that she was retaliated against for helping the club and that the school district’s decision to release her was based on her status as a gay woman. Defense counsel contended that the recommendation for non-renewal was lawful, non-discriminatory and non-retaliatory based on Frost’s conduct. Counsel also contended that the ACLU letter alleging anti-LGBT policies and practices, and the majority of Frost’s allegations, were received well after the decision was made to recommend non-renewal., Frost claimed she suffered a loss of past and future income. However, during the course of the litigation, she obtained employment as a teacher in Northern California. Frost also claimed she suffered from physical ailments and emotional distress, in addition to costs and attorney fees, as a result of the alleged events.
