FACTS
In 2016, plaintiff Mark Rosen, 59, a police captain for the city of Beverly Hills, allegedly had some of his assignments reassigned. He claimed that after Sandra Spagnoli was hired as the city’s chief of police, he began to be discriminated against based on his age and his Jewish religion and culture. He also claimed that after he complained, he was retaliated against. Rosen sued the city of Beverly Hills. Rosen alleged that the city’s actions constituted violations of the Fair Employment and Housing Act, including discrimination based on age and religion, retaliation, and failure to prevent discrimination and/or retaliation. Rosen claimed that Spagnoli and others began to discriminate him and other police officers by using derogatory comments beginning in 2016. Specifically, Rosen alleged that he was demeaned and ridiculed about his age and his Jewish religion and culture. He also alleged that he was reassigned with lower level work without justification, denied overtime assignments, and prevented from being promoted. Rosen further claimed that he was retaliated against after he complained about the discrimination. Defense counsel asserted that there was no discrimination against Rosen based on his age or religion and that Rosen had assignments rotated like other command staff. Counsel also contended that Rosen never complained to the city prior to filing his Fair Employment and Housing Act claim. Counsel further contended that once Rosen filed his claim, the city retained an outside attorney investigator, who completed a 476-page report regarding his investigation into Rosen’s claims., Rosen sought recovery of damages for his emotional distress as a result of the alleged discrimination and retaliation. He also sought recovery of lost wages.
