In November 2017, the plaintiff, a 15-year-old girl, was allegedly raped by Neil Kimball, 44, a detective in the sex-crimes unit of the Los Angeles County Sheriff’s Department. The girl was previously raped by another individual. In the summer of 2017, when her father learned about the prior sexual assault, he reported the incident to the Los Angeles County Sheriff’s Department. Kimball was assigned to investigate the earlier incident, and, with the permission of the father, Kimball took the teenager on "ride-alongs" so that she could talk about the details of the assault that he was tasked with investigating. During the ride-alongs, Kimball wore street clothes and he took the teenager to public areas. However, on the fourth ride-along, in November 2017, Kimball wore his Los Angeles County sheriff’s uniform, including his badge and gun, and drove the teenager to a recreational vehicle parked in Camarillo. While there, the teenager was allegedly handcuffed to a bed and forcibly raped. The teenager’s father, acting as the guardian ad litem for his daughter, sued Kimball and Kimball’s employers, Los Angeles County and the Los Angeles County Sheriff’s Department. The father alleged that Kimball’s actions constituted sexual assault, battery and a violation of his daughter’s civil rights. He also alleged that the county and sheriff’s department were negligent in the hiring, supervision and retention of Kimball. Plaintiff’s counsel contended that Kimball, acting under the color of law, raped the teenager. Counsel contended that, during the investigation, Kimball groomed the teenager to gain her trust during the ride-alongs and that, during the fourth ride-along, Kimball, while wearing his uniform, drove the teenager to an RV parked in Camarillo, where he urged her to drink beer that he had purchased. Counsel contended that when the teenager asked to be taken home and attempted to get her cell phone, Kimball grabbed her, forcibly threw her to a bed, handcuffed her and raped her., The teenager claimed that she was forcibly raped by Kimball. She alleged that as a result, she suffers from psychological problems, including emotional distress and anxiety. The teenager sought recovery of damages for her physical and emotional pain and suffering.
